Last Toast Terms of Use (End User Licence Agreement)

Effective date: 4 November 2026

These Terms of Use ("Terms") are a legal agreement between you and New Version Limited, a company based in New Zealand ("we", "us", "our"), the publisher of the Last Toast app ("Last Toast", "the app"). They apply when you download, install or use the app on any device, and to any purchase you make in it.

By using the app you agree to these Terms. If you do not agree, do not use the app. Our Privacy Policy explains how the app handles information; in short, we collect no personal data from the app. Both documents are available in the app under Settings, then Legal.

Your consumer rights are not affected. Nothing in these Terms excludes, restricts or modifies any right or remedy you have under a consumer protection law that cannot be excluded or limited by contract. This includes, depending on where you live, the New Zealand Consumer Guarantees Act 1993 and Fair Trading Act 1986, the Australian Consumer Law, the consumer laws of the European Union and the United Kingdom, and similar laws elsewhere.

1. Who these Terms are with

These Terms are concluded between you and New Version Limited only, and not with Apple Inc. or Google LLC. We, not Apple or Google, are solely responsible for the app and its content, subject to the limits in these Terms.

2. Your licence to use the app

We grant you a personal, non-exclusive, non-transferable, revocable, limited licence to download, install and use Last Toast for your own personal, non-commercial entertainment, on devices you own or control:

You may not:

The app and all of its content are licensed, not sold, to you. We and our licensors keep all rights not expressly granted to you. Open-source components included in the app are licensed under their own licences, which you can read in the app under Settings, then Legal, then Open-source licences.

3. Free play, the Last Toast Pass and subscriptions

Free play. Without paying, you can host Case 1 in full for 4 to 6 guests, play pass-and-play, play with computer guests, take the training, and keep your records and badges. Guests always play free: anyone can join a party hosted by someone else, whatever that host has bought.

The Last Toast Pass. The Pass is bought by the host. It lets the device that hosts run parties for up to 12 guests and unlocks additional cases, including cases released after you buy. The Pass is offered as:

The prices above are the US dollar price tiers. The stores set the price in your country and currency, which may differ and may include taxes. The price you will pay is always shown in the app and on the store before you confirm the purchase.

Payment. Payment is charged to your Apple Account or Google Play account when you confirm the purchase. Apple or Google handles all payments; we never see your payment details.

Auto-renewal. A weekly or yearly subscription renews automatically at the end of each period, at the then-current price, unless you cancel it at least 24 hours before the end of the current period. Your account is charged for the renewal within the 24 hours before the current period ends.

Free trial. If your yearly subscription includes a free trial, it converts automatically to a paid yearly subscription at the end of the trial unless you cancel at least 24 hours before the trial ends. If you cancel during the trial, you will not be charged. Any unused part of a free trial ends when you buy a subscription. Trials are offered only to eligible users as decided by Apple or Google, normally once per account.

How to cancel or manage a subscription. Deleting the app does not cancel a subscription.

When you cancel, the Pass stays active until the end of the period you have already paid for, and then stops renewing.

Price changes. We may change subscription prices. Apple or Google will tell you in advance as their rules require, and where the law or the store requires it, a price increase will not apply to you unless you agree to it. If you do not agree, you can cancel before the new price takes effect.

Refunds. Purchases are processed by Apple or Google, and refunds are handled by them under their own policies; we cannot issue refunds ourselves. For App Store purchases, request one at https://reportaproblem.apple.com. For Google Play purchases, see https://support.google.com/googleplay/answer/2479637. Nothing here affects any statutory right to a refund or other remedy you have where you live, for example if the app has a major failure or is not as described.

Restoring purchases. If you reinstall the app or move to a new device signed in to the same Apple Account or Google account, use Restore purchases in the app (Settings, then Last Toast Pass) to get your Pass back. Purchases cannot be moved between Apple and Google accounts.

Changes to what the Pass includes. We may add cases and features to the Pass over time, and some new cases may be available only with the Pass. We will not remove the core benefits of a Pass you have already paid for during a paid period, except where required by law, by the store, or for security reasons.

4. Playing responsibly and age guidance

Last Toast is a party game. Please play it with care for the people around you.

You are responsible for your conduct and your party. We are not responsible for how guests behave at an event where the app is used.

5. Fictional content

Last Toast tells fictional stories set in 1958. All characters, places, organisations and events in the cases are invented. Any resemblance to real people, living or dead, or to real events is coincidental. The game includes references to murder, poisoning, death, alcohol and drug misuse, presented as fiction for entertainment.

6. Intellectual property and AI-generated content

The app, including its name, logo, cases, story text, rules, artwork, music, code and design, is owned by New Version Limited or its licensors and is protected by copyright, trademark and other laws. These Terms give you a licence to use the app, not ownership of any part of it.

The character portraits, scene artwork and music in the app were generated with artificial-intelligence tools (Grok Imagine and Suno, through the Kie.ai service) during development, then selected, edited and bundled in the app by us. No AI runs on your device or in the cloud while you play, and nothing you do in the app is sent to an AI service. AI-generated images of fictional characters are not intended to depict real people, and any resemblance is coincidental.

Any name you type on your name tag is yours. You give us no rights in it, and it is not sent to us.

7. Updates, availability and support

We may update the app from time to time to fix problems, improve it or keep it compatible with your device. Some updates may be needed to keep using the app or the Pass. We may change or stop offering features, cases or the app itself, but we will not do so in a way that takes away a paid benefit during a period you have already paid for, except as allowed in section 3 or by law.

We provide support for the app by email at lasttoast.support@newversion.studio. We are solely responsible for any maintenance and support for the app, to the extent required by these Terms or by applicable law. Apple and Google have no obligation to provide any maintenance or support for the app.

8. Disclaimer of warranties

Last Toast is provided for entertainment. To the fullest extent the law allows, the app is provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. We do not promise that the app will be uninterrupted or error-free, that it will work on every network or device, or that a party will never be interrupted by a dropped connection.

Consumer guarantees. If you are a consumer, the law gives you guarantees that cannot be excluded. In New Zealand, the Consumer Guarantees Act 1993 requires, among other things, that goods and services are of acceptable quality, fit for purpose and supplied with reasonable care and skill. The Fair Trading Act 1986 prohibits misleading and deceptive conduct. In Australia, the Australian Consumer Law gives similar guarantees, and the laws of the European Union, the United Kingdom and other places give equivalent rights. Those rights apply regardless of anything in these Terms, and this section applies only as far as the law allows. Where a warranty cannot be excluded, it is limited to the shortest period and the narrowest remedy the law permits.

9. Limitation of liability

To the fullest extent the law allows, and subject to the next paragraph:

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, for breach of the consumer guarantees or other rights that cannot be excluded or limited under the law of your country, or for any other liability that cannot be limited or excluded by law.

10. Ending these Terms

You can stop using the app at any time by deleting it. Remember to cancel any subscription separately in your store account (see section 3).

Your licence ends automatically, without notice, if you materially break these Terms. When it ends you must stop using the app and delete it. Sections 2 (restrictions), 5, 6, 8, 9, 12 and 13 continue after these Terms end. Ending these Terms does not by itself entitle you to a refund; refunds are handled by Apple or Google as described in section 3, and your statutory rights are unaffected.

11. Terms required by Apple and Google

If you got Last Toast from the Apple App Store, the following also applies, together with Apple's Licensed Application End User License Agreement (Standard EULA) to the extent it is not changed by these Terms. If anything in this section conflicts with the rest of these Terms, this section applies.

If you got Last Toast from Google Play, your download and purchases are also subject to the Google Play Terms of Service, and Google's payment and refund rules apply to purchases. Google is not a party to these Terms and is not responsible for the app.

12. Governing law and disputes

These Terms are governed by the laws of New Zealand, and the courts of New Zealand have jurisdiction over any dispute arising out of or relating to these Terms or the app, except that this does not take away any right you have under the mandatory consumer protection laws of the country where you live, or any right you have to bring proceedings in your local courts. Where such laws apply to you, they prevail over this section.

Before starting any formal proceedings, please contact us at lasttoast.support@newversion.studio so we can try to resolve the issue informally.
